Justified Actions

Do you think that a person with a mental disability should be punished for murdering another person? If no then does that mean that he is not a person? If so what is a person?

I don't think that person should be punished, he or she does not know what they have done wrong or doesn't understand the situation they are in, and just because were not punishing a disabled person doesn't mean they aren't human it just means that they don't have the mental stability to acknowledge what they have done or accept a punishment. It also depends on how severe the mental disability is. I think they should be in an institute if they are dangerous or given mental help.

  2. I dont think that a person with a mental disability should be punished, and it doesn't mean that they are not a person, ofcourse they are a person but also its a person with an illness. Instead of giving them a punishment we should help them with their illness look for different ways to cure that person, or he/she should be kept in an asylum.

  3. i do not think an individual with a mental disability should be punished for murder. Due to their disability they are unable to rationalize and understand their actions. This is not grounds for the regular sentence. However because of this the system should help them.

I agree with all your responses, and in response to my own question, I also say people should not be punished for murder if they have a mental illness, but i believe they should at least be punished for something because if not they might not ever learn. I personally for my community service hours have worked who kids my age that were autistic and one thing I have learned is that they are just like us, its just that they have trouble telling right from wrong and my teachers in charge of them told me that I have to let them know what they have done is wrong and that they have to be reminded that certain things are good and others are bad. So personally I do agree with you guys, just that a nice slap on the wrist wont hurt that must, not implying we should hit them it was an expression. So thank you for your responses.

  5. No. I believe that if someone has a legitimate mental illness they should not be punished for committing murder. They are obviously not stable and don't realize what they are doing. What's the use of punishing someone who doesn't even know what he or she has done?

    But at the same time, the person shouldn't be let free. They should be admitted into an institution of some sort so that they can get the help they need and be kept somewhere where they won't harm the rest of the population.

  6. I believe that certain accommodations should be made for the criminally insane, but they should not be free of any consequences. I think that those with mental disabilities should not go prison, but they should be put into psychiatric hospitals. This also doesn't apply to all cases of psychiatric problems. I think that much more work needs to be put into how the justice system handles insanity pleas, in particular with regards to how long the criminals are required to be institutionalized.

    I don't believe that the loss of ability to think rationally stops one from being a person, especially when many mentally unstable people retain times of lucidity and are able to function perfectly fine in many areas. Mental disorders are too varied to make any kind of general statement.

  7. I don`t think a person having a mental disability should not go unpunished if they were to kill some one. If they are to go unpunished then it would be very easy to use the excuse of having a mental disability as a way of killing people go unpunished. Like I have said before, killing is wrong in every and any aspect. Regardless of the situation, it is never right for anyone. You guys are saying the person with the mental disability can`t rationalize what he/she is doing, or can't think straight and your lists go on. It is so naive you guys would believe that. They were able to rationalize in their brains who they wanted to kill and why they wanted to kill them. If they can go as to think that far, then there are just no excuses. There are plenty of people with mental disabilities that don't go around killing people, so what is the difference?
